Know Your Rights: 5 Rights That Unmarried Couples Should Know (2024)

Valentine’s Day is around the corner and love is in the air. In India, society is still getting accustomed to the fact that consensual unmarried couples are free to be in India. The boundaries of relationships are expanding in India and it becomes imperative for couples to be aware of their rights and responsibilities. Today, we’ll explore the 5 rights of unmarried couples in India that we should be aware of to make informed decisions and safeguard ourselves.

1. Unmarried couples can book a hotel together

Many hotels in India refrain from accepting bookings made by unmarried couples. But, you should be aware that there is no law in India that prohibits unmarried couples from booking a hotel room together, if they have valid ID proofs. Article 21 of the Indian Constitution gives unmarried couples the right to privacy and safeguards them from such hotels that might harass them for being unmarried!

We at Saltstayz celebrate love and welcome every couple with all our hearts. We offer clean and safe rooms, and our staff has been specifically guided to not cause any trouble to our guests regardless of their marital status. We also have rooftops where you can enjoy an intimate dinner with decorations and have a memorable Valentine’s Day with your partner.

2. Unmarried couples can book a hotel in the same city as their residence

There is no such law that prohibits unmarried couples from booking a hotel room in the same city as their residence. As long as you have a valid ID, you’re allowed to book a hotel room in your city, even if you reside in the same city.

3. Unmarried couples are allowed to be together in public

No law in India prohibits unmarried couples from wandering and sitting in public, as long as they’re not involved in an obscene activity. You can go to any public place in India. If you’re going to places with cultural or religious places, it is advised to take a look at their specific rules and follow them. It is your responsibility to ensure that people around you are not uncomfortable with your presence as it can hamper your experience together as an unmarried couple.

4. Valid age for checking in any hotel

Even though there is no law that prohibits unmarried couples from booking a room together in hotels, there is a minimum age requirement by the law. You and your partner should be a minimum of 18 years of age while checking in to any hotel. Hotels reserved the rights to cancel your bookings if you’re not able to furnish any valid ID proof supporting your age.

5. Police cannot arrest unmarried couples for being present at a hotel or any public place

As long as you’re not involved in any obscene activity or any illegal activity, police cannot arrest you for being at a hotel or any public place. Having a valid ID proof is enough and you’re not liable to furnish other proofs of showing relation with the person you’re staying with.

However, if you’re found performing any obscene activity in public, police have the right to book you and your partner under Section 294 of IPC which comes with up to 3 months of imprisonment.

These are the rights that every unmarried couple should be aware of. You should always choose Saltstayz as your stay partner, long-term or short-term. We also offer day-use rooms for those who want the rooms for some part of the day. Saltstayz also offers rooftops and banquets where you can enjoy your Valentine’s Day!
